Can a temporary staffing company that is working under a subcontractor to GC file a lien in Oklahoma on a commercial project?

Staffing company bills subcontractor for temp labor provided on an hourly basis. Staffing company has not been paid by subcontractor. Does temporary staffing company have lien rights like other subs & suppliers have?

Mechanics lien rights are based on many factors, but the type of company filing a lien isn't really a consideration. Rather, the type of work performed and the hiring party would be more influential. In Oklahoma, any party who provides labor or materials for the “erection, alteration, or repair of an improvement” is entitled to a mechanics lien. This includes parties hired by a subcontractor. Thus, if the work performed would normally give rise to lien rights in Oklahoma, the fact that the party providing that work is a temporary staffing company would seem to have little effect.
