We are a well established, 16 year old timber frame company in Montana. We have been approached to put together preassembled roof trusses to ship to a jobsite in California. Can we send one or more consultants to the site to aid in installation? Do we need to obtain a building contractor's license in California? Would our worker's comp insurance be valid there? Could the general contractor on the job temporarily hire our individual or crew?
You can sell the trusses in California, but without a California contractor's license you cannot contract, in California, to perform work that requires a California contractor's license. The buyer of the trusses can bring you in to consult, but the framer that installs the trusses needs to be licensed in California. And, you are at risk of losing the money paid to your company if you do contract to do work without a California license, under Business and Professions Code section 7031. Yes, I suppose the GC can hire your crew, but they would have to be hired as and paid as employees of the GC.
