That's a good question, and we get that question fairly often here. In fact, we wrote an article on the topic not that long ago: Can I File A Lien If My Workmanship Is In Dispute? Anyway, workmanship disputes should not prevent a mechanics lien filing. Claims over allegedly poor work can certainly come into play during negotiations or in an action to challenge or enforce the lien. However, because an actual lien filing is as simple as recording the lien document with the county recorder, no fact-finding or deliberation over work quality will prevent the filing of a lien. Of course, a lien claim should always be made in good faith, so it's important to only include amounts due and owing.
