Can a licensed HVAC Florida contractor hire workmen paid with 1099 to perform work that was contracted under the contractor's license?

The short answer is probably not. A licensed HVAC contractor is permitted to hire employees and to have them perform work under the company's license. Once you start hiring and paying workers and sending them a 1099, you are treating them like independent contractors. Setting aside the possible labor and employment law issues or IRS/tax issues you might be creating, you are not permitted to allow an unlicensed independent company use your license to perform work. Nor is the unlicensed independent person allowed to rely on your license to perform work. The scenario you are describing raises a lot of issues with construction licensing regulations, labor and employment law, and tax law. I would stay away from it completely, or consult with an attorney who may be able to walk you through some sort of acceptable way to perform this work this way.

A contractor hired me piece rate he was supposed to pull out taxes and workman's comp . I got hurt the first week . He then paid me with a co ck instead of a payroll ck when I went to hospital, he refuses to let workman's comp pay it What is the law
