We are a large commercial flooring contractor and we completed partial work that was billed for. Now Contractor wants to not pay that months draw due to scheduling delays. Is that legal?
Patricia, when a job is not going well, it is not unusual for contractors to find excuses not to pay. Much will depend upon what your contract says and the circumstances of any delays. Even if you had delays, they may be excusable due to market conditions, prior subs delaying your work, etc. If you would like an honest assessment of your situation from a legal perspective, please reach out to me and we can schedule a consultation. If we find that your money is being held improperly, there are important deadlines in the lien law (and likely in your contract) that you will need to meet to preserve your right to be paid.
