Can a document that needs a notary signature be executed through Docusign?

TexasLien Waivers
Anonymous Contractor

Hello, I see that Texas, Wyoming, and Mississippi are the states that require notarization for lien waivers. If those particular forms require notarization, are the forms still able to be executed via docusign? Thanks so much, Christen

Actually, lien waivers do not need to be notarized as per Texas Property Code Section 53.284. The forms do not list a notary or notary inscription.

A mechanic's lien must be acknowledged before a notary.

Mobile or remote notaries are permissible in Texas.

Retain a construction attorney to evaluate your situation, and to provide advice.

Good luck.

Hello,

DocuSign currently does not have the capability for notaries. The answer to you question is therefore No.
