Can a contractor withhold certification of occupancy from an owner?

contractor was paid by homeowners. Contractor didn't pay sub contractors. Contractor is asking for additional $$ to pay the subcontractors and will not release CO until additional $$ is paid. it is unknown what the contractor did with the money paid to reimburse subs.
