Can a contractor sue a client for nonpayment without first filing a lien against the property?

A mold mitigation contractor was hired and authorized to charge my insurance during a water damage claim we opened. They contacted us for payment after work was done and we explained they had to charge the insurance directly. We filled out a form for them consenting them to charge our insurance with all the information needed. They followed up about a month later asking for payment again with an Intent to File Lien, we replied saying they have to charge insurance not us. Now almost a year later, they contact us again, it appears they never received payment from my insurance and now they are demanding us the client for payment in the next 10 days or they take the necessary legal action to collect the remaining balance due. But they never explain if they ever charged the insurance or not. Can they proceed legally? Thanks for your help.
