Can a contractor file a lien against my property for work that he did for the builder prior to my closing?

I live in a gated community and closed on my house November 16th. A pool was installed prior to my closing and was part of my contract for teh house with the builder in the community. It seems that the builder is holding back final payment to the pool company for reasons unknown to me. The pool company is threatening to file a mechanics lien against my property unless the builder pays him. The builder no longer owns the property - can the pool company do this? Thank you.

Has the pool company sent you a Notice to Owner? Assuming the pool company sent a Notice to Owner, then yes they can lien the property for the unpaid amount. You should get with your builder to demand they pay the pool company to avoid the lien. If no Notice to Owner, then probably not an enforceable lien.
