As a homeowner how do I protect myself from a unscrupulous contractor trying to put a mechanics lien on my home?

A contractor hired to perform tile work did an extremely poor job. The tiles are not installed correctly and look like garbage. And they didn’t complete all the work that they were hired to do. We got fed up and told them to leave the job. They sent an invoice for the total amount due if they completed the work properly and all of it. we paid over 1/2 due and deducted for the poor workmanship and incomplete work. They are threatening us with a mechanics lien without even trying to negotiate the unpaid amount. How can I protect myself from this unscrupulous contractor?

Give my office a call. 260-782-1712. We routinely handle this type of case. Did you have a written contract? If so, I'd like to take a look at it. Typically, most contractors don't have stautory complaint contracts. That said, you could get 3x damages and attorney's fees if we send the proper notice to the contractor. Per statute they can file the lien. We can send a notice requiring that the prosecute it or it is deemed void. Also, there is an option to submit surety to the court to remove it. If they record a lien you can send them a demand to sue under the Illinois Mechanics Lien Act which requires them to file suit within 30 days from the date of receipt of the notice or the lien is forfeited. Also, when did they last work on the home?
