As a GC, what is the best course of action to recoup loses for defects in subcontractors work.

We are a GC on a private project in Washington state. One of our subcontractors completed their scope of work and were paid everything but retention. On the punch walk, the owners and their inspectors rejected the work from our subcontractor and are now requiring a complete replacement of the work, at a cost that is well over the remaining unpaid balance to the subcontractor. The subcontractor is unable and/or unwilling to complete the work. What are our options?

Put an indemnity agreement into your contract with all subcontractors.

You can keep the retention, but your only other option is to sue the sub for the cost to complete.

Retention of the remaining subcontractor holdback, and suit vs. the subcontractor for your damages as GC.
