Are we able to take legal action for past due payments?

MichiganCollections

Hello, I work for Detroit Wallpaper Co. We produce and sell custom wallpaper products. We worked with a design firm about a year ago and have still not been paid in full for our products. Is there anything I can do to get our money? We are owed just over $4,000.

Yes. If your customer isn't responding to your calls, and the debt is over a year old (beyond the time to consider a construction lien) you can take them to small claims court. You don't need a lawyer to do this. Small claims courts are a division of the local district court. Usually, a claim is filed with the district court where your Customer's main office is located or conducts business. If you tell me where your customer is located, I could tell you in which court you should file. There are about 100 district courts in Michigan. To file a small claims case, you'll need to fill out a form DC84, which is located here: https://courts.michigan.gov/Administration/SCAO/Forms/Pages/Small-Claims.aspx For a $4,000 claim, the filing fee should be $70.

Yes there are likely a few claims you could bring. We could schedule a conference call.

You could save time and money by simply letting a certified commercial collection agency licensed and bonded in Michigan to collect it on a contingency bases. If you just want your money, email srauch@rauchmilliken.com or call me for a free quote. Best regards, Steve
