I’m a subcontractor for a land clearing contractor on a commercial job and completed the job on August 15, 2021. The engineer and company of the job signed off on the services provided as acceptable. The contractor refused payment and after threat of lien finally paid the remaining portion minus retainage. My contract specifies that retainage is due 30 days after the final invoice date and sign off from the engineers. That date would be September 15 which has now passed and the contractor is not responding to payment request via text or phone or email. Am I within my rights to move forward with the lien process for the portion of the retainage payment still due?
