Am I required to have my subcontractors (who didn't file pre-liens - we are located in CA) issue lien releases before I can get paid by the client - note - there is no mention of having to furnish lien releases of any kind in my contract ?
There is no specific requirement that lien waivers must be provided built directly into California lien law. However, it is not uncommon for property owners to request / require lien waivers be provided by the direct contractor and for all parties down the chain (or an affidavit of the contractor that all lower-tiered parties were paid) prior to payment, though this is usually set forth by contract.
