Am I eligible for the mechanics leanif I only offered serices?

ArizonaLien DeadlinesMechanics LienPreliminary Notice

I am an Auto Mechanic and I own the business. I am just barely getting my business license. I have a customer who is not paying. I did not know about the 20 day preliminary form so I never mailed one. Am I still able to get a lien on this vehicle? Also am I required to send out the 20 day form? If so should I just sent one out for every customer I get? Also will it matter that I did not have a business license at the time of the repairs? Thank you for your time.

Strange as it may sound, mechanics do not have the right to mechanic's liens for vehicle repairs. Mechanic's liens are for improvements to real property, not repairs to personal property. The lien you are thinking of is a garage lien, which is governed by A.R.S. § 33-1022. The lien exists by virtue of the fact you have possession of the vehicle and repaired or stored it. You do not have to give the vehicle back until the bill is paid. The amount paid must have been agreed to by the owner of the property, so the lien is on much firmer legal grounds if you have something in writing agreeing to the amount of money owed.
