Once the lien is filed, you may file a legal action to foreclose on the lien. The lien foreclosure action must be filed within one year of the recording date of the lien. After that, the lien expires.

I see you are a subtractor. Did you file the lien or did the general contractor? liens by subs are tricky; did you have an attorney draft it? Other factor is the amount owed, whether significant enough to justify hiring an attorney to file a foreclosure case in your Circuit Court.

The above response is provided as a courtesy and does not establish an attorney-client relationship. If you would like to contact me directly for a consultation, I am located in Port Huron (810) 987-3970. Since 1975.

I strongly suggest you hire a knowledgeable attorney to assist you. When you say a lien was filed on a business there is multiple potential pitfalls ... Is the Business who contracted for the improvement the actual owner of the property? Was a notice of commencement issued that gave notice that the owner of the building was on notice that an improvement was being made? If not the lien may be difficult to enforce.
