a lien filed by a prospective general contractor

I am a lender on a project that is in the permitting stage. project manager has talked with general contractor about building the apartment project. general contractor filed a lien. general contractor has no contract for the building. Claims are based on "management" and "bidding work". How can a lien be filed without a contract on a commercial project (multi-floor apartment project).

Mechanics lien rights arise as a result of work that's performed but not paid for. And, for lien rights to exist, the claimant must have provided some tangible, permanent improvement to the project property. Notably, some Oregon claimants will be entitled to mechanics liens for design and planning work - but that only applies for architects, landscape architects, surveyors, or registered engineers who prepare plans, drawings, or specs intended for improvement of the property. However, bid preparation and management will typically not give rise to mechanics lien rights, themselves.
