I am a general contractor and I am working on a garage addition. The subcontractor I hired to do my concrete foundation work severely screwed up and I have already paid him all but about $5,000 of the signed proposal price. There are services that were paid for that weren't completely fulfilled and what was fulfilled was not correct. The building inspector failed us due to elevation not being appropriate. After being told they wouldn't have the time to fix their mistake for another week and at this point it was already 3 weeks I had to hire a different subcontractor to correct the foundation which required demolition of the freshly poured concrete. In order to complete the correction I had to pay some of my crew members to come in and help, paid for materials as well as delaying the completion of the project by at least 40 days. We are performing work in a project in a mall, Citadel Outlets, and the landlord requires additional insurance coverage not mentioned in the contract with the GC. The General Contractor does not want to cover the cost of this additional insurance, and since we were unaware of this requirement, we do not meet it, nor would we want to pay the extra fees it takes to purchase it. I am a contractor, we did some work on a building with a contract and the customer has defaulted on said contract but has offered to make payments, and has in fact made 1. but i was wondering can we put a lien against his assets, and not a mechanics lien on the property itself. Own an industrial building and tenant hired air conditioning contractor for installation of unit and ducting. Just learned the contractor, with whom we did not know and did not deal directly with filed a mechanics lien WITHOUT us ever being given a 20 Day Preliminary Notice. What do we need to do to get this wrongfully filed Mechanics Lien removed? What damages to us could result from this lien? What claims do we have against the contractor? What claims do we have against the company that filed the mechanics lien on behalf of the contractor but did not confirm that the 20 day notice had not been given to the owners? As owner of a project, I was served a Mechanics Lien due to a supplier not being paid. The GC claims the lien amount is not correct and thus is arguing with the sub (plumber) and the supplier to correct the lien amount which the supplier is not willing to change. In the meantime, he asked me to bond off the lien so he can be paid by the bank. What should my next step be? ...Read More
