I am a design professional. I have a contract and bills. The ex-client, we fired her with-cause, has not paid balances due. Can I file a Mechanics Lien in Indiana?
Some design professionals are entitled to file mechanics liens in Indiana. Under § 32-28-11-1 of the Indiana mechanics lien statute, "Registered professional engineers, registered land surveyors, and registered architects..." will have the same mechanics lien rights as contractors, subcontractors, etc. do.
Note, though, that it appears those parties quoted above will be the only types of design professionals entitled to mechanics lien rights, as the statute is written. So, design professionals other than registered engineers, surveyors, and architects would likely not be entitled to lien rights.
