Florida Partial Unconditional Bond Waivers

This is a Florida Partial, Unconditional Bond Waiver form. Also referred to as a Florida Unconditional Bond Wavier for Progress Payments. This form can be filled out with a PDF editor or by hand after printing.

This waiver is used on public projects in Florida in exchange for a progress payment. This form waives the right to make a claim against the project’s payment bond for any amount on the project. Florida statutes require that these forms be used to waive the right to make a bond claim. Alternative forms may be used if both parties agree. But a contractor cannot require you to use a form different than the one provided here.

Because this Florida bond waiver form is unconditional, it should only be used when  payment has actually been received. Signing this form signifies that you have been paid in full. If payment has not been received, if the check hasn’t yet cleared the bank, or if there is some other reason why payment might ultimately fail, this waiver should not be furnished. If this is the case, signing a Florida Partial Conditional Bond Waiver is the safer option.
