Florida Final Conditional Bond Waivers
This is a Florida Final, Conditional Bond Waiver form. Also referred to as a Florida Conditional Bond Waiver for Final Payment. This form can be filled out with a PDF editor or by hand after printing.
This waiver is used on public projects in Florida in exchange for final payment. This form waives the right to make a claim against the project’s payment bond for any amount on the project. Florida statutes require that these forms be used to waive the right to make a bond claim. Alternative forms may be used if both parties agree. But a contractor cannot require you to use a form different than the one provided here.
This Florida bond waiver form is conditional, as allowed by Fla. Stat. §255.05(2)(e). The waiver is just as valid as an unconditional waiver, except it will not become enforceable until payment is actually made. If payment has already been received and deposited, you may be requested to execute a Florida Final Unconditional Bond Waiver.
