About Texas Partial Conditional Lien Waiver Form
Fill out the fields to download a free Conditional Waiver and Release on Progress Payment form, also known as a partial conditional lien waiver. This form was created by construction attorneys to meet the Texas lien waiver requirements. Keep in mind that Texas rules are strict: Altering the language in the document could cause the waiver to be invalid.
Lien waivers are regulated by Texas mechanics lien statutes. A valid waiver will release the signing party’s right to file a lien for the amount listed in the form.
About this waiver form
The Texas partial conditional waiver (also called a partial conditional lien release) should be used when a progress payment on the project is expected. There may be future expected payments on the project, but this waiver form applies only to a specific progress or partial payment that has yet to be received.
- Read the Guide: How to fill out a Texas Partial Conditional Lien Waiver form
Because this lien waiver is a conditional waiver, it is ok if payment has not yet been received. The waiver is conditional on the receipt of the payment and will be invalid if payment is not ultimately received.
Texas is one of 12 states that has a statutory requirement for specific language to be included in the lien waiver. If you are furnishing materials, labor or services in Texas, make sure you are using the correct form. Levelset’s free template is in compliance with what is statutorily required. There is no room for debate about the contents of the lien waiver document because the state legislatures typically render any non-statutory lien waiver forms as completely null and void.
Pro tip: If payment has already been received in full, an unconditional waiver may be more appropriate.
