About the Texas Monthly Notice Form

In order to protect the right to file a lien for labor and/or materials furnished to a private project, subcontractors and suppliers must send a Texas Monthly Notice form. This is a type of Texas construction notice that is required in order to preserve the contractor’s right to file a mechanics lien claim if unpaid.

Under the new legislation, monthly notices must be sent by all subcontractors and suppliers to the property owner and the original contractor to secure lien rights for that month.

Commercial projects: no later than the 15th day of the third month after the month:

• Labor and/or materials were provided; or

• The undelivered specially fabricated materials would normally have been delivered.
