It should not be confused with California’s Lien Waiver and Release forms, which are used to waive lien rights in exchange for payment. Use this form to partially release or cancel a lien in California

The Partial Discharge of Mechanics Lien Form is used to only partially cancel a lien that has already been filed. This lien discharge or release form is used to cancel a portion of a lien that has already been filed. For example, after a mechanics lien claim is partially satisfied, a claimant may wish to partially release the lien to reflect the amount paid.

After completing the lien release form, it must be filed at the same California county clerk’s office where the original lien was recorded.

A partial lien release may be a risky filing, as it is intended to release part of the right to claim a lien, and it is not guaranteed that counties would not record the document as a full release, or that it will not otherwise detrimentally affect your rights if you choose to complete and file this document.
