Be very careful when signing an Unconditional Waiver and Release on Final Payment form. If payment has not been received, if the check hasn’t yet cleared the bank, or if there is some other reason why payment might ultimately fail, this unconditional waiver should not be signed. If this is the case, signing a “conditional” waiver is a safer option. Signing this final payment waiver and release signifies that no further payments are expected following the payment described in the waiver.
