Filing a Preliminary Notice of Lien Rights will protect your right to file a Georgia mechanics lien in the event that a prime contractor files an affidavit attesting to the payment of all subcontractors and suppliers. After filing, a copy of the filed notice should be sent to the owner and general contractor by certified mail return receipt requested within 7 days.

Georgia statute requires the notice to be filed “within 30 days after the date a party delivered any materials or provided any labor or services for which a lien can be claimed.” This could mean 30 days after you first provide labor, or the last day you provide materials, or vice versa. It’s a good idea to file this notice as early as possible.

Parties may opt to file a preliminary notice of lien rights. In order to be effective, the preliminary notice of lien rights must be filed with the clerk of superior court of the county in which the real estate is located within 30 days after the date a party delivered any materials or provided any labor or services for which a lien may be claimed.

Is a notice of commencement and/ or preliminary notice necessary before filing a lien?

In Georgia, if you have a contract with the GC no preliminary notice is required. In South Carolina, you must send a notice of furnishing labor or materials, but there is no stringent time deadline for that notice. In both states your claim of lien must be recorded within 90 days after your last day of providing labor or materials for the project. I hope this helps clarify.
