A North Dakota Notice of Intent to Lien is a critical step to secure your ND mechanics lien rights on private construction projects. This North Dakota lien notice form is required to be sent by all potential claimants at least 10 days before filing a mechanics lien claim. Plan ahead, as the deadline to file an ND mechanics lien is 90 days from the last date the claimant furnished labor or materials to the project.

This notice must be sent to the property owner by certified mail and considered served upon actual receipt by the owner. If sent late, this means the lien claim will also be filed late. That doesn’t mean you can’t file a lien, but the lien protection will be limited.

Information you need to complete your ND Notice of Intent to Lien Form
  • Owner’s information
  • Hiring party’s information
  • Description of labor and materials provided
  • Dates work was performed
  • Property description
  • Amount of the claim
