Massachusetts Notice of Written Contract Form

You can file your Notice of Written Contract at anytime once work begins on a construction project in Massachusetts. After construction, there are limitations on when this can be filed (earlier of w/in 60 days from filing of Notice of Substantial Completion, or 90 days from last labor/materials or filing of Notice of Termination).

This is not a deadline, but a reminder for you to consider filing this document to preserve your lien claim.

ATTENTION. This deadline may be shorter if a Notice of Substantial Completion was filed on the project. If this notice was filed on the project, be sure to put this date into the LienPilot to ensure your earlier deadline is calculated, and then dismiss or disregard this deadline.

However, if a Notice of Substantial Completion is not filed on the project, a Notice of Written Contract must be filed within 90 days from when you last furnish labor and/or materials to the Project. This is the first step to creating the mechanic lien in Massachusetts. The second step is due 30 days later (filing Statement of Account).

In MA, a Notice of Written Contract must be filed within the earlier of two dates: 60 days from filing a Notice of Substantial Completion, or 90 days from last furnishing labor and/or material or filing of Notice of Termination.
