Rules and regulations for sending a Virginia Mechanics Lien
In Virginia, liens must be filed within 90 days from the last day of the month in which labor or materials are last furnished to a project. If sooner, the lien is due 90 days from the completion of the project. The most prudent way to calculate the lien deadline is to calculate 90 days from the date of last providing labor or materials. This period has expired, and it is time to file your lien.

Virginia law allows you to record your own lien independently of the GC assuming you meet the criterion for a valid lien. You also have the option of "piggy backing" on the GC's lien should it file one but I don't usually recommend that.

The best way to do so would be to get a lien waiver in exchange for payment. Otherwise, the contractor could record a lien for any work performed and unpaid. Recording a lien for any amounts owed for work that was not incorporated into the project would render the lien invalid, but that would take court action to prove.

In this scenario, a mechanic's lien won't work because of the license requirement. Also, he cannot remove what is already attached to the land/tear out any hardscape or other items. The lack of a license complicates the collection, though there could be an unjust enrichment argument on your behalf. This last would be a tough sell, but depending on the amount owed, may be worth a shot.
My advice is to get the license ASAP to avoid this problem in the future.
