Legal Property Description

Often, it will reference a property survey, recorded map, or adjoining property. The legal property description can include the lot and block, township-section-range, and/or the parcel number.

In many states, the legal property description is a required field on construction payment documents. This includes construction notices and mechanics liens. In other states, it is not required, but it is recommended.

States where it’s required to identify property in a mechanics lien: Alaska, Arizona, District of Columbia, Iowa, Indiana, Ohio, Oklahoma, Michigan, Missouri, Wisconsin, and Wyoming.

States where it is recommended, but not required: Colorado, Georgia, Kansas, Louisiana, North Dakota, Tennessee, Texas, South Dakota, and Washington.
