Who should use the Warning Statement form
Subcontractors and suppliers who are working on an alteration or repair to an existing property (not new construction) must provide a warning statement in order to retain the right to file a Kansas mechanics lien if they are unpaid. Sub-tier parties on new construction projects must use a different form, known as a Notice of Intent to Perform.
General contractors and other parties who contract directly with the property owner in Kansas are not required to provide a preliminary notice or warning statement.
How to use this form
After downloading the form, fill out the form fields completely and accurately. Once completed, the form must be sent to the property owner at any time during the project prior to filing a lien. It’s best practice to provide this warning statement form at the beginning of the project to ensure timely payment.
This form was prepared by construction attorneys to meet the requirements found in Kansas Code § 60-1101 et. seq., as adopted by the Kansas Legislature.
Rules and regulations for sending a Kansas Preliminary Notice
This is not a hard deadline. A "Warning Statement - Notice to Owner" must only be filed before a lien is filed. This deadline marks 2 months after your last furnishing date. See Levelset's Kansas FAQ pages for more information about this notice and deadline.
After completing the Kansas Warning Statement Form, you must deliver it to the appropriate parties required by statute. Notices are typically served on the property owner and, for sub-tier parties, the general contractor. However, depending on the type of notice, it can be helpful to send notices to anyone else who is in charge of your payment, like a lender or surety company on the project.

Whether a notice is necessary and/or you have complied with the notice requirements is dependent on a number of facts. See K.S.A. 60-1103a and K.S.A. 60-1103b. You need to balance the cost of having an attorney review the matter verses filing a defective lien.

is, no. If the facts might not be accurate or complete you should consult an attorney.
Mechanics lien/ contacting a homeowner
Your description of "hourly subcontractor" needs to be explored. I recomend you contact an attorney. You may be able to proceed through the Kansas Department of Labor, individually for violation of the Kansas Wage Payment Act, and/or filing a lien.
