What are Marquette County's requirements for recording a mechanics lien?

The Marquette County Register of Deeds Office’s recording requirements are as follows:

I. The name of each person purporting to execute the instrument must be legibly printed, typewritten, or stamped beneath the original signature or mark of the person. MCL 565.20 I Sec. I (a)( c)

2. A discrepancy must not exist between the name of each person as printed, typewritten, or stamped beneath the signature and the name as recited in the acknowledgment or jurat on the instrument.

3. The address of each of the grantees must be printed in each deed of conveyance or assignment of real estate, including the street number address if located within territory where street number addresses are in common use, or, if not, the post office address, is legibly printed, typewritten, or stamped on the instrument. MCL 565.201 Sec. I (d)

4. The name and address of the person who drafted the document must appear on documents executed in Michigan. MCL 565.20 la, 565.203; person defined: MCL 8.31, 55.265(g), 205.803(h), 207.522(a)

5. Documents purporting to convey or encumber real estate executed in Michigan must be acknowledged by a judge, clerk of the court of record or by a notary public. MCL 565.8, MCL 565.47

6. A certified copy of the death certificate or proof of death must be recorded when the instrument of conveyance states “survivor’ in the grantor’s section. MCL 565.48

7. Court orders must be certified and sealed by the clerk of the court to be eligible for recording. MCL 565.401 , 565.411. See MCL 8.3n which permits electronic seals to be affixed to electronic court records.

8. The document submitted for recording must be legible. MCL 565.20 I Sec. I (t)(iv)

9. Documents must have a margin of unprinted space at least 2 1/2 inches at the top of the first page and at least 1/2 inch on all remaining sides of each page. MCL 565.20 I, Sec. I (e)(iii), Sec. I (t)(i)

10. Documents must display on the first line of print on the first page, a single statement identifying the single recordable event that the instrument evidences. MCL 565.201 Sec. I (t)(ii); 565.20 I Sec. 3

11. The form must be printed with black ink; type size at least 1 0-point type. MCL 565.20 I Sec. I (t)(iii)(iv)

12. The paper on which the document is printed must be white and not less than 20-pound weight. MCL 565.20 I Sec. I (e)(iv), Sec. I (f) (iv)

13. The size of the document and any attachment thereto must be at least 8 1/2 inches by II inches; at most 8 1/2 inches by 14 inches. MCL 565.201 Sec. I (e)(i i); (t)(v)(vi)

14. Unless state or federa l law, court order or rule requires that all or more than 4 sequential digits of the social security number appear in the instrument, the first 5 digits of any social security number appearing in or on the instrument are obscured or removed. MCL 565.201 Sec. I (g)

For entering and RECORDING any Deed, Mortgage, Lis Pendens, Certified Copy or other instruments:

*$4.00 of this fee is deposited to the Michigan State Survey & Remonumentation (MSSR) fund.

(The $4.00 MSSR fee is not assessed on Fixture Filings, Federal Liens, State Liens, MESC Liens, State Deeds, Plats or Tax Reversion Documents, MCLA 600.2567a(4))

Any documents which assigns or discharges more than one instrument: $3.00 shall be added to the recording fee for each additional instrument so assigned or discharged.

Warranty Deeds, deeds which contain a covenant of warranty, Land Contracts or Assignment of Land Contracts must have a tax certificate from the County Treasurer’s office. MCLA 211.135:

Each additional description $.20
Effective OCTOBER 1, 2016 in the State of Michigan
Regardless of the number of pages, all documents will cost $30.00 to record. This cost is inclusive of Michigan Remonumentation and Register of Deeds Automation fees. For a document that assigns or discharges more than 1 instrument, $3.00 for each instrument assigned or discharged (in addition to the $30.00 fee). To certify a recorded document $5.00; copies remain at $1.00 per page. Transfer Tax fees and the $5.00 Treasurer’s Tax Certification fee is still due for those documents that require it.
