A Virginia lien typically only obligates the owner to pay claimants from money it has yet to pay the general contractor. Subcontractors and suppliers who send 43-11 Notices to the owner and/or general contractor before beginning work or supplying materials take the first step to reverse this, and obligate the owner to its claim. The second step is after work is complete, where upon a second 43-11 notice must be sent. This second step is due within 30 days of completion of the claimant’s work.

If you delivered a 43-11 Preliminary Notice before beginning work, this is the deadline to provide your 43-11 Post-Work Notice. Both notices must be sent to take advantage of Section 43-11, and prevent the property owner from raising the Defense of Payment.

There should not be another step. If a lien is not enforced within the time frame it becomes dead letter. However, some title companies will request a release be recorded.

Is there a Notice of Commencement required for a private project (parking garage & site with apartments to follow)?
No. Only preliminary notice requirement is to Mechanics’ lien agent, if one is identified on the building permit, for one two family residential structures.
