In Texas, this notice is required by different parties depending on the type of project.
On commercial projects, all lower-tiered subcontractors and suppliers (i.e. those who didn’t contract directly with the Original Contractor) must deliver a Texas monthly notice to the Original Contractor on the 15th day of the 2nd month after the unpaid work was performed. On residential projects, all subcontractors and suppliers must sent this notice to the Original Contractor and the Property Owner within the same timeframe. This notice is also commonly referred to as the “Texas Fund Trapping Notice.”

Pro tip: Lower-tiered subs and suppliers on commercial projects are required to send a notice both on the 15th day of the 2nd month, and the 15th day of the 3rd month, following each month in which work was performed and unpaid. Is a construction contract binding if the contractor fail to meet completion date and does not submit a change order ?
Very VERY generally speaking, you are authorized to withold from final payment the amount necessary to repair any work that the contractor failed to perform or correct. However, there's a complicated statute that partially governs residential construction disputes in Texas called the Residential Construction Liability Act (Tex. Prop. Code Chapter 27). I'm telling you this to warn you that there are hoops home owners must jump through to protect their claims against errant contractors. In that regard, I recommend at least reaching out to an attorney to discuss these issues in a private and privileged setting to get a broader and more accurate idea of your options.

CAN I FILED A LIEN ON PROPERTY
Hello,
Mechanic's and materialman's lien under Chapter 53 of the Texas Property Code if you are within the deadlines or Constitutional Lien under the Texas Constitution if you are outside of the statutory deadlines and you are the general contractor on the project.

Unpaid projects past dates to file
Very often yes. While your company may have missed deadlines to secure statutory liens, that is a very common issue and it typically does not mean you cannot send demand letters, threaten lititgation, and if those attempts fail, file suit against the nonpaying general contractor under probably several causes of action.
