The state of Indiana. I provided architectural services to a contractor for work at a residential home. The contractor paid me my $1,000 retainer. This project started in August of 2021. I provide preliminary sketches to the contractor. After modifications, we made final drawings which were provided to the contractor for use on Sept. 28, 2021. To date, I have not been paid the remaining $3,000 owed. I have sent multiple notices by email and text. I gave him an ultimatum of today (12/2). He says he has been paid but checks need to clear and is going to pay me tomorrow (12/3). I told him if it is not paid tomorrow I will take the next steps. I will file a lien on the homeowner's property. I have to go out to the property on Monday to take photos and check on the construction status, which will include me filing a field report with him and the owner. Do I have to file a pre-lien notice to the owner, contractor, both...or do I not have to file one and just go straight to filing a lien on the property?...Read More

In California, can a Owner of a private project hold a progress payment to a GC because they have not received unconditional waivers (GC & Subs) from the previous months pay application? My Owner is continuously late on progress payments and they are claiming that they do not have unconditionals from the previous month. I am a steel subcontractor working on a public job in Alabama. I have two separate "contracts" for this job. A purchase order for the steel materials and a subcontract for the steel field erection services. The GC has had all kinds of problems on this job and is likely facing some liquidated damages. As such they are looking for every possible pocket to back charge including mine. No matter how false the claims, they are using a "throw it against the wall" approach and see what sticks. Yesterday the informed me they are holding payment until they can confirm or argue many of their so called "back charges" for delays. So, I would like to file liens to protect myself. (a) do I need to file separate liens for the PO and the subcontract? I would think I would? (b) I currently have billing that is 20 days past due and more coming due in about 15 days. I am a plumbing subcontractor working on a commercial job for a GC. The GC is refusing to mail my payment to me (which is already 30-60 days overdue) unless i sign an UNconditional waiver - or they refuse to mail my check. I tried to explain how the waivers (unconditional/conditional) work- but they are obviously do not understand the concept. They keep telling me they refuse because they can't leave themselves unprotected and it would be "bad business"- and that I am the "only sub on his jobs that seems to expect these 'special conditions'" and that I am "misconstruing the lien laws." We are only halfway through this pretty sizeable project-and I would rather file a prompt pay act violation than filing a lien-it's not the property owner- I know the owner has paid the GC- so I am not looking to make problems for the owner if not necessary.- but the pay apps were approved long ago and there are no issues with my workmanship- it is all the GC just not wanting to pay me. I am about to have a meeting with the GC and they have stated to me they REFUSE to release the money to me without that unconditional-so I just want to have my "ducks in a row" and say with utmost confidence that they are wrong- and it is breaking the law to hold my money for ransom for that waiver ...Read More

I was hired by a guy I called my friend. He was hired by a disaster restoration company. He wouldnt tell me what company, or which insurance company. I performed services and provided materials for plumbing repairs. When I gave him the invoice he began to question everything on it. He also became verbally abusive. He told me he required all of my receipts for materials. I do have mark up on my parts. I also added profit and overhead to the bill. I can’t seem to get him to call me back. I performed this work on time and materials. No upfront contract. I also have been made aware that the house has asbestos in the mud of the walls and I did cut holes which has exposed me. With a contract in hand and a promise from this person that to help me to get the ball rolling and will refund my money whenever i want to quit.
