Dear Sir, Sorry to contact you, I got your name from the internet research and from one of the articles(Budde,Nathan) you have published, hoping to get some guidance from you. I am new in construction industry. I started by building my own house. I hired a construction manager to build our own house and to enter in the construction industry. I found out one vendor myself for dive way pavers and backyard pavers. We signed a contract with him to finish above project of drive way and back yard for X amount of money including labor and materials charges. He completed job. He made me buy $ 6363.88 worth of material which I bought on my credit card and provided him. I mad him a full payment and provided material worth $ 6363.88 which he was supposed to purchase himself. Out of nowhere, I got a certified mail from a supplier from whom this vendor of mine bought some materials stating that they are bringing a lien against my property in the sum of $ 16621. 91 and included copies of 14 invoices which I have no knowledge of. So , I already paid my vendor his labor and material cost for the contract ,I have to pay again to the supplier of his the material cost even though I paid my vendor not only the material cost but also $ 6363.88 material I bought for him on credit. I am paying the material cost twice. Is there any justice in the USA? Can you show me how should I handle this situation. What does it mean to be licensed in the state of Virginia in order to file a mechanics lien? I don't know what that means to be licensed. How do we become one if we are not? We are only a material supplier. We're not providing any services in VA. Why do we need to be licensed?...Read More

We worked as a sub-contractor under a General Contractor on a project, and the General Contractor had us sign a unconditional waiver and release on final payment form even though we have not been paid anything on the entire project yet. I have the document we signed, does that waive our rights to file a mechanics lien. At the end there are several instances that I believe I may have a stand on filing a Mechanics Lien please let me know if I am correct in my thinking. I'm a consumer who had a licensed contractor install a new roof an solar on my house. Before signing and throughout the project I've told them verbally and in writing that I would require a lien release from the contractor, subcontractors, suppliers, AND everyone who worked on my house. From the California State Licensing Board website I've read that "Laborers" can put a mechanic's lien on my property if not paid, and that I should require a lien release from all Laborers. The problem is that now the prime or direct contractor is trying to say that employees are NOT "Laborers" and that the lien release signed by the direct contractor, subcontractors, and suppliers covers their "employees" who are NOT "laborers" and thus cannot file a mechanics lien. My question, under California's mechanic's lien law are contractor "employees" "Laborers" who can file a mechanics lien?...Read More

Do not have contract but have a signed acceptance of proposal from homeowner. Invoiced weekly and were paid weekly. Agreement states we are to receive "10% of total cost of project upon satisfactory completion." Job is on hold due to permitting but during this time, homeowners decided to terminate the agreement we were working under. Invoiced for the 10% of the cost of the work we completed up until they terminated without notice or reason and they say they are not paying because the project is not complete. l have been leasing a mechanic shop since 1994 with an option to buy from the owner. $350 per month out of the rent went towards the option fee. The agreement also stated that l did all the construction at the property to bring it to code which will be deducted from the purchase price.
