The apartment complex hasn't paid for service for a period on 6 months to one year and a half. So we've just been waiting on payment. They owe us close to 10,000 and haven't paid. We haven' t even included late fees and past due amounts. It would be over 10,000. They had to make budget cuts a few years back and of course security, maintenance, housekeeping etc. We're part of the cut backs and are owed money. We need this balance that they created paid. We delivered material for a COD customer. They paid half over the phone after delivery, their credit card could not cover the entire amount in one day. They ordered parts incorrectly and reordered replacements. The delivery day for the replacements parts we asked payment on all materials delivered prior to that date. They refused, saying we had no right and that they had already paid us, also stating that we should be responsible for the incorrect parts, although it is documented that they ordered incorrectly. We said our hands were tied. Later we stated that we would be happy to deliver the material as long as the material that had already been taken by the customer was paid and we could sort out payment for the replacement delivery on a later date. They refused now saying that we never got approval for the order and therefore could not charge them for it or deliver it. My friend, an elderly woman of 87, is attempting to evict a tenant for breach of an implied contract. She exchanged rent for labor to remodel 2 units. The contractor has not completed the work that was agreed upon at this time. It has been 10 months and she is now trying to evict. She was forced to hire someone to complete the work. I am a homeowner who wants to put a lien against my property next door. The house has been abandoned for about 3 years, owners deceased and no next of kin. Currently, the bank owns it, it has back taxes and will be on Sheriff Sale in July. I had to hire a landscaper to cut down 2 trees, they were over 2 stories high in back yard as it was causing damages to my roof and siding on my house. Then, there were squatters, after the police asked them to leave. A new customer of ours had us fabricate material for their first big job. They would order and we would receive payment prior to delivery. I larger portion of the order (roughly $10,000 of fabricated material) was delivered on 5/12/2019 and their card was charged for roughly half that amount. Over the weekend they noticed that two of the parts were incorrect. Come Monday they held payment off because of the mistake, but our salesman visited the job and determined that the parts were ordered by our customer incorrectly and we provided what was ordered. He explained this to their company owner and their employee at which point the employee asked for us to fabricate the replacement parts PLUS one other large piece that they did not order. The owner called to confirm the delivery of the order, meaning he was aware it was ordered. We called to receive payment on the previously delivered material but were met with problems with their office manager as she said she did not approve the order. She is disputing the invoices and has refused payment. Will this be an issue when filing a lien? What are my options to assure that I get paid?...Read More
