Completed a project that was substantially completed earlier this year where we requested the final invoice to be paid. They were past their 30 days of payment when they advised us the fans installed did not work to their satisfaction. We agreed to fix these and provided additional fans to increase the air flow they wanted. The re-work has been completed as on June 28. We allowed them to work with the fans prior to requesting final payment. They now advise us the fans provide to much air which entail has to much wind noise and do not want to pay for this portion of the project (which is the outstanding balance). They have stated that the new work does provide the quality of airflow however are not happy with the wind noise (which is only at maximum level and it’s 17 fans set on 6 variable speed controllers), this is their reason of not wanting to pay. We the work provided was on the original contact, the fans were requested to provide air flow during the hot Arizona days under a covered arena. We would like to know if we are able to lien this project....Read More

We were hired on as an electrical subcontractor. On a remodel that was supposed to take 6 weeks but turned into a year. We had an original contract for a few rooms in a residential property but the home owners asked our GC to add more to our original contract so there was a change order, then another contract for a panel change, then another change order but a verbal agreement that at the end of the project we could turn in all the change orders. Well the supervisor employee of the GC who made the verbal agreement got fired at the end of project 2 days before we agreed to send in the remaining change orders. We explained to the new supervisor employee of GC our agreement with the fired supervisor and he said that if it was never in the original contract then we needed to take the bill to the home owner. We reached out to the fired supervisor who verbally asked us to do the change orders and he signed a statement stating that he gave the approval for the change orders. Since getting that signed we have tried contacting the GC. He has ignored our emails, calls, and text which forced us to send a notice of intent to lien. That too has now been ignored. So, I reached out to the home owner while being ignored by the GC and let them know the situation. They informed me that they had paid the bill in full to the GC and that we needed to discuss the matter with the GC. We reached back out to the GC with still no reply, we sent the home owners a notice of intent to lien that was ignored, sent the home owner emails explaining our situation and it was ignored. We have a house that was renovated in South Bethany DE and had some work done by a subcontractor electrician who was fired from the job by the contractor. The contractor stated the electrician didn't complete the work properly. Contractor also paid the electrician upfront, per their contract, for parts and services with remaining balance due upon completion. I knew the contractor fired the electrician for poor work. The electrician has sent two letters threatening to put a mechanics lien on our house for the balance of the work he never completed. We paid the contractor the final draw on 6/14/19 and received the certified letter on 6/17/19. Since we are paid in full with the contractor, shouldn't the electrician be going after the contractor? It's beginning to become harassment from the electrician at this point. The letter was sent from his office in MD to the Trustees' house in MD. Any advice would be greatly appreciated....Read More

Hello. We own a painting company in Kansas and the majority of our work is interior apartment painting. I have a complex that is now not paying me. Our terms are net 60 and they have outstanding invoices from March. to the tune of $30k. I have tried for weeks to work with the manager and regional manager on payment. They have been very unresponsive. I have never had to file to collect payment in 5 years of owning this business. There is no contract persay as this is all for on going work. I do have emails from the property manager confirming the work requested. How do I go about filing a Lien? Also, our terms state that a 10 percent late fee will be add to any invoices over 60 days. Can I assess those costs? What about filing fees? Do I need to hire an attorney to do all of this? Can I collect from them my attorneys fees as well? Thank you in advance for your help!!...Read More
