What is considered permanent improvement/mechanic lien protection? We have Service Calls and Preventative Maintenance works for one owner. All properties locate at DC. The invoices the owner owe us include monthly Preventative Maintenance Agreement Billings, and individual Service Calls. Can we file mechanic lien for the unpaid invoices? How to consider these invoices as jobs when filing mechanic lien? i.e. Can all the unpaid service call invoices and monthly Preventative Maintenance Agreement billings for one single property be considered as one job to file one lien?...Read More

My Client lives in Italy, but has a local business address and local bank account She has leased a 2100 sf space in a major shopping mall to establish a retail shoe business She hired me to create drawings for the remodeling and improvement of an existing space at the Mall I completed all the drawings for my Client who than used them to get bids from Contractors She has paid me only 1/3 of my fee, prior to my completing the Contract Documents After several weeks of waiting for payment on invoices sent to her, and which she agreed to pay and stated several times that she was sending payment, she has since stopped communicating with me I sent her a "Breach of Contract" notice along with several invoices in which I demanded immediate payment for work completed to date via email She has refused to communicate with me via email, phone or texting I have a signed agreement with her that she reviewed and signed in Italy after a trip here to Los Angeles to sign her lease with the Landlord of the Shopping Center I want to recover my Fees, so do I have a right to Lien her business, business assets and/or her local 'bank account'? I hired a handyman to install spray foam insulation. He was paid in full prior to the project. He verbally told me he would be doing the work, his invoice states he will be doing the work, the invoice is under his name (not a company name). He (without my knowledge) hired another company to do the work. 73 days later this other company came to me door. I gave him the address and phone numbers for my handyman. He stated he wasn't paid..and I thought it could be a scam. 85 days post install they filed a lien on my property. This was the first time I had the name of the company, and dollar amount. Is this lien valid? No pre-lien notice, they were not authorized to work on my property, my handyman did not have the authority to bring in additional people, and the amount this company charged was well over the expected price. I have a situation where I was as to fix a roof on a barn for a lady and the first weeks hours were tallied and the amounts was paid but this week's hours she refuses to pay stating that we were not working for an hourly amount instead we were working as if it was a hard money bid which was never discussed nor agreed upon nor was it so the week prior when we were paid for hours worked. Now she is under refusal to pay and although and unlicensed contractor I feel I should be able to apply for a mechanic's lien until are amount is satisfied and furthermore now we have to go back and put the barn in a safe condition causing more lost in time and man-hours. After I retired, someone asked me to remodel a building. Basement, First and Second Floor. The amount I requested when finished is extremely low. Even so, I was paid part of it. Mechanics Lien has been filed for over $8000.00. They offer half the amount. I don't want to accept. My attorney says litigation might cost me up to $16000.00 and i'm discouraged to file law suit. I spent my own money for supplies materials etc. Plus labor. The owner stated, that we agreed on $15000.00. I'm not a contractor. I just have skills and a will. Proof I have are emails only. Hi. We are a small business in Georgia and want to know if we have rights to file a mechanics lien on a private property. We emailed a quote to a property owner and they responded via email that they were good and we in turn ordered the materials from the supplier. While we don't have a written contract, we do have an email saying that the owner wanted to move forward. Since then, the property owner cancelled the job and my distributer wants a 50% restocking fee for the materials. The materials are still at the warehouse. I'm a general contractor. A subcontractor agreed to install driveway pavers, that I supplied, for a set price, that was about the same as other bids. He sent me an invoice for almost twice what was agreed to. Now he threatens to file a lien. We are a material supplier who ordered material for our customer (the subcontractor) per the customers instructions. The material was special order and was about 75% complete when the customer cancelled it. The manufacturer of the special order material is now charging a restocking fee to us.
