A local business hired a main contractor to do a remodel who then subbed it out to another guy who then had my boyfriend finish the job as his "employee", as my bf doesn't have his own licence yet. I know for a fact that the main contractor was paid in full for the job and supposedly still hasn't paid the subcontractor that hired my boyfriend so therefore my boyfriend hasn't been paid and the verbal agreement was for about seven Grand. We're not sure how or who needs to go about doing what to get paid...Read More

For NJ, it says "Lien must be filed within 90 days of last providing labor or materials". Can I file a lien from the last day I provided labor to pick up stored materials? I worked on a project for a couple of months, my last day working there was 7/12/2019 At this point the project was on hold, then on September 2019 I was told the project was canceled. I picked up stored materials at the jobsite on October 2019 So can I file the lien from the last day I was there, on October?...Read More

In some cases, our company is selling material to customers under the Safe Harbor rules (namely, relating to a tax deduction for U.S. manufacturing businesses - which provides a safe harbor provision allowing businesses to take the tax deduction if at least 20 percent of the total costs are the result of direct labor and overhead costs from US-based operations). In such cases, our customers are purchasing material and then storing it until needed for a project. Because the material is not being delivered to a project site, where it will be affixed to a property, is it true that we cannot consider delivery dates until such delivery is to the actual project site? Hope that question is clear. Please advise and thank you....Read More

I’m a general contractor and had a verbal contract with a client (Who I’ve done the exact same type work for her before except a smaller scale) About 70% of the work was done and I get a text saying she has an unfavorable doctor visit and will let me know when to resume/finish work. When I went to her house I saw her sanders and her shopvac outside. (I’m assuming she is trying to finish floors by herself) She hasn’t paid me at all and I have bought most of the materials myself. She refuses to respond to any of my text and phone calls and won’t answer the door so I can at least get me tools. What type of lien can I file in (Shasta County) Redding, California....Read More

A company performed emergency water restoration services. The insurance company suspected the contractor was charging inflated fees and performed unnecessary serves. The insurance company had na independent audit completed and confirmed that this company was guilty. Further, the only document I signed was to permit the company to receive payments directly from the insurance company. The insurance company paid for reasonable charges as determined by the audit. The company has since billed us for the difference. The want to lien against our homestead even though my husband and I did not sign a contract and consequently the contract was not filed. We build swimming pools and as the general contractor take out the building permit for the project. Five months ago the project was completed as far as construction was concerned. However, the renter at the building project has not allowed the city inspector to make a final inspection for the job. Does this fact play the project in "not completed" which would allow use to lien his property, or would the final work on the project be the determining date....Read More
