My NTO was sent in the first 45 days of being on the job, but I didn't have owner information and couldn't find it. I sent the NTO to my customer, who is the GC. We're now past the 45 days to send the NTO, but if I can find the owner and resend the NTO, would that protect my job? Or am I out of luck as far as meeting my NTO requirement? Are there any provisions for amending an NTO after the deadline? Thanks....Read More

Hello - thank you for this website 1. I served the lien after filing it. The owner's attorney is saying it is invalid because I had to serve before filing. Is that true and if so, what can I do? 2. I never served the 20-day preliminary notice. I was hired by the owner-builder. He is claiming that since he was technically the GC, as a sub I was required to file that notice. Please advice. Hi, I am in the process of selling my home. An ex employer from 6 yrs ago just popped up claiming that I owe him money and is going to put a lien on my property. What should I do? I do not owe him anything. I am aware of the money he is speaking of but we had an agreement that it was all taken care of prior to me leaving the company. We did have the agreement in writing. A client requested technical support not related to a specific project. the technical assistance is a T & M type billing for service ticket support. Once we completed the work, we send a T & M invoice with data on what was performed. The client has net 30 day terms. In this case, he refuses to pay for no other reason then he did not think he should have to pay due to the fact that they would be updating their system at a later date and would call us at that time. I am a utility contractor. We completed our preliminary work on the project. Then the grading contractor came in to do his work. We then came in to finalize our phase of the project. Upon arrival we discovered numerous damages done by the grading contractor and I made him and the engineer aware of the damages and made necessary repairs, and calculated and shared the repair total. My client in San Mateo County, CA took delivery of three floating shelves from us, and has not remitted their final payment of 25% to us, after several/many calls from both me and my wife. We would like to be paid our final 25% which is clearly stated in the Statement of Work (SOW) that we provide each and every client. Our payment terms of very clear; 75% down and 25% at delivery. The 75% down provides me the ability to buy the wood and materials for their custom project. We send them all the materials they need to place their shelves where ever they'd like in their home. I believe that my only recourse is to file a Mechanics Lien to receive final payment.
