Im a subcontractor working on a residential project. We finished nearly all the work and the customer had us stop work at the kitchen so he could install new cabinets (7 day break), he paid the majority of the bill at that time, leaving $1300 left until after we returned to finish the kitchen. My main question is what is my deadline for filing a lien? We finished our work and invoiced our customer about 67 days ago.Their payment terms are net 30, so they are quite a bit late. I want to make sure we don't miss our Lien window for this project. But this is an odd customer arrangement. The property owner (apt complex) agreed to have a car share program install EV charging stations on the property and leave cars there for the tenants to rent out. The property owners would not pay anything because they wouldn't be the owners of any of the infrastructure or equipment, the car share company would be the owners. That company hired a project management company to handle all of the details after they procure the sites. i.e. contractors, construction schedules, payments, etc. This project management company are the ones who hired us. We did all of the designing, engineering and building. What is our Lien deadline and will this odd setup affect how we lien if it goes that way? ...Read More

Hello! I’m an homeowner and had some work done in my house and used a general contractor. I paid 50% and the remaining balance was supposed to be paid when the project is completed. We had lots of problems and mistakes were made. We failed inspection and the general contractor wants me to pay the remainder. I said not until the job is completed. He quit! I am part of a staffing agency who supplied general labor to a company that was a subcontractor on a job. We filed a lien on June 14th 2017 and we have workers out on the job up until April 9th 2017. We sent 2/3 Month notices via certified mail also once the labor ceased (Account was suspended). It is my understanding that the lien should be valid, however I was reached out to by a person stating this: ""The Statute states that property owners are liable to a perfected lien only (1) the extent to which the owner withheld retainage from the original contractor, and (2) the extent to which the owner made payments to the original contractor after receiving fund-trapping notices from subcontractor(s). Above mentioned statute applied: 1) In order for Results (My company) to have a claim on the retainage the lien is statutorily required to be filed no less than 30 days after a project is abandoned. In this case Mid July is more than 30 days after Kuehn abandoned the project. We can evidence this by our having to pay a dumpster to be hauled off after Kuehn stopped communicating with us in May. Results would still have a claim if there was any retainage still paid/owed to Kuehn after their notice was sent, but in this case the entire 10% retainage amount was offset by unperformed, but paid for, work. 2) The first "fund trapping" notice LWORH received as Owners was, as stated in Results Lien Affidavit, June 14th 2017. We didn't make any payments to Kuehn after mid may as a result of their abandonment. Therefore there is not claim available for "trapped funds" either.""
