We're a staffing company, and are in a situation in NC where we're considering filing a lien on a project, and are now realizing that we originally sent our prelim notice to an address that is incorrect. Our customer gave us the address of a parking lot, which is where the employees met up for work, but the work was done at a different location down the street. I remodeled a home for a property owner who lives in California but is purchasing homes in Texas to make rentals I took care of the project completely meantime communicating daily with the home owner she sent incremental payments throughout the job as I was purchasing all materials and funding project as well when I finished I sent her a bill for the remaining amount due she then said she wasn’t happy with some things and I ask like what she sent 6 photos and said there is other things to I said well send me all items and i will be there 2 days from now and I will fix all the things your not happy with so two days later I let her know I’m heading there and haven’t recieved any other items so I assume there wasn’t anything else I sent photos before during and after repairs were made and no response so again I requested final payment she says i have To wait for my property management guys to walk the property this has beeen 4-5 weeks ago now she told me yesterday I’m waiting on property management company to give me numbers on repairs I haven’t forgotten you I replied numbers? I’m not sure what you mean I asked you for a list of any issues I repaired the things you gave me were wrong I said o would take care of anything your unhappy with and you haven’t sent anything and once again no response so she owes a remaining balance of 7,387.65 what can I do or would I at least be able to recover the money i spent on materials the remaining amount out of pocket is 1,987.21.. unfortunately I’ve been doing this for 10 years and have never not gotten paid so I was oivious to lein laws...Read More

If I paid a contractor to build a pole barn on my property. My contract said he was doing the concrete but come to find out he subcontracted it out and didn’t pay the guy. The concrete guy is threading me and says he is placing a lien on my property. What is the time frame he has to file I have a picture from 10/23/19 that he completed the concrete. I have a contractor who threatened to place a lien on my property due to non final payment. Contractor finally completed the project in which I was promised in writing it would take one month to complete (contractor was 5 months late). Contractor also stated in writing he would deduct $100 per day for every day he was late in completing the project. I received the final bill and the $100 per day deduction was not included. I explained that to the contractor I was not going to pay the billed amount without the $100 per day deductions; however, contractor is disputing the claim and is now threatened to put a lien on my house. I am a Home Inspector in Albuquerque NM. I performed an inspection as requested and scheduled by the prospective buyer and buyer's agent of a detached single family dwelling. During the inspection I was informed that the property owner is responsible for payment. My policy is to be paid at or before the inspection as is stated in my confirmation/quote sent out prior to the inspection date. I contacted the seller's agent after the inspection and made this policy clear and sent the agent (at his request) an invoice for payment. As you may know, the State of New Mexico is currently devising a licensing system for Home Inspectors. I am in compliance with all current state requirements but do not have as yet a state issued Home Inspector License since such a document is not yet available in New Mexico. I do have a Small Business License issued by the City of Albuquerque. Can I file a mechanic's lien if payment is not made in a timely manner?...Read More

A residential home builder hired my company to do Audio, networking, burg alarm, cameras. We started work in oct 2018. The ongoing project just finished up. Our last day onsite was 3-16-2020. After the builder made a bunch of changes over the course of the project the homeowner (son of the builder) does not want to pay. I have had no direct dealing with the son. We are in the Property Restoration - Emergency Response Industry providing an array of services including but not limited to Water Mitigation. While the industry description of Water Mitigation Services can include properly cleaning, sanitizing, drying, repairing, and restoring a property to pre-water damage condition, many of our Mitigation jobs do not include restoration or repair. We generally invoice our repair services separately under a Structure Repair job invoice/ID. Our question is, for our California branches, are our Mitigation (cleaning, sanitizing, drying) balances eligible for the filing of a lien.
