I am a general contractor in ohio and have filed a mechanic's lien on the property owner. The contract I have is with his tennant and the owner states he was unaware (and very well could have been) of the project and his attorney has sent a letter asking me to voluntarily remove the lien stating that in Ohio I cannot file a lien on his property since he had no knowledge or contract for us to do the work there. Good afternoon, I'm a home stager who staged a home for a client on May 6. Their home immediately went under contract and now they say they're strapped for cash and can only pay me a portion of the entire bill - he wants to be on a "payment plan". However, his home will be closing by June 2nd and that doesn't give me a lot of time to collect from him. The contractor withheld the fact that he paid the one person and refuses to pay the other employees. Our custom home was to be completed October 1, 2019; the contractor quit in January. He never filed a proper "Stop Work" notice--only stated so in an email. No notice was ever filed on the property, given to us as owners or served on the bank. He simply sent an email stating "this serves as my official stop work notice". Is he liable for time lost and expenses to us as the owner now that he's tied up our property with an untimely filed lien? (Quit January 8 and filed his Mechanics Lien May 1, 2020.) I am a land owner who has leased several tracts of land to construction companies. The construction companies are allowed to hire contractors to perform work, erect buildings etc...on the property. Although my contracts say that the construction companies are not to allow liens to be put on the property, sometimes their slow pay process, does cause contractors to place mechanics liens against them, and on the property that I own. I want to avoid allowing liens on the property that I own by my Lessee and the way that they conduct business. If I require the construction company to obtain a payment bond prior to the work being performed, can I require a lien waiver or subordinate the lien somehow to the Payment Bond?...Read More

I am a contractor that contracted with a tenant of a commercial shopping plaza to do a remodel. The tenant owns their own clothing company and has a store in the plaza. The owner of the plaza sold place to new owner back in December 2019. The lien notice and affidavit claiming lien were filed per deadlines. The lien was released in December in exchange for $8k from selling owner to myself and my promise to make effort to collect from tenant with the hope of paying back former owner. The tenant was unaware of this transaction. I re-filed the lien in March 2020. Original filing deadline was january 2020. Is newly filed lien valid? I am a subcontractor worked on 7 projects for GC. Was paid on 2 but late, was partially paid on 1 more, but not in full. Most recent project is 30 days late on payment. The oldest is 120 days late. Contacted the owner about GC not paying. Owner took all jobs away from GC, but no communication with us. GC is threatening to sue us for talking to the Owner because "it cost us our jobs" and claims we breached contract after we didn't show up for the job. We didn't show up for the job because lots of projects have been completed and not paid, so we finished the last project and didn't start the next one. GC has been told for weeks prior that we have no more cash to continue working. I know GC will be paid this coming Friday by the Owner.
