Our company did a job for a client that had damage to his apartment . This damage clean up was approved by his property manager that had got approval from there corporate office. The corporate office gave the customer a credit on his rent for his inconvenience and agreed to pay for the clean up to our company. When we gave the invoice to the customer to pay we found out he had taken the check that the corporate office sent him to pay us and had cashed it and spent the money . We decided to lien an ongoing job because it appeared to be ending in the near future. Shortly after we filed the lien, it appears the job will go longer. The invoices on the lien were paid, but there are now several more invoices that are going unpaid. Are we able to add the more recent invoices to the lien or file a second lien? I understand that Washington requires contractors provide a model disclosure statement to the owner at the start of work, and I may lose lien rights if I don't provide it. However, someone told me that not sending it is worse than that even, and that I'll be in violation with the DLI for not sending the Model Disclosure Statement. Is that true? Contracted with a customer on 6/10/19 last year, at the end of the project, this customer filed a claim with the CA CSLB, they started their investigation, the investigation ended 6/16/20 - Work modifications had to be done and they were finished. The customer has paid all but $23,058.62 I sent her an invoice to pay yesterday and of course, she ignored, so I want to file a lien but also give her lien releases for the monies she has paid. Just need a little guidance so she can understand that this is now a collection issue and that she could be in trouble if she don't pay....Read More

We are a General Contractor for commercial work in AZ and DC. We were told to halt all work due to owner having lost their funding on the projects. There was not a Notice of Completion or Cessation recorded by the owner for either location. The AZ project, we obtained a Temp Certificate of Occupancy. We also have open/pending Change Orders that we had not received approval on (executed document). Can these be included in our lien claim? We placed a lien on a property in Washington. After we placed the lien on the property, the customer did request additional work. We originally planned to just add the change order and have the customer pay in full. But let's say we release the lien and add the change order, which will change deadlines. For a reno project my general contractor estimated costs and explicitly told me most of the time he over-estimates and adjusts as necessary. The plumbing estimate was $4500. The work took a total of 15 man hours to complete. The general contractor told me the plumber will not adjust the bill despite tje general contractor’s promise to adjust Over-estimates. This is an egregious over-charge. $300 an hour is twice industry market standard. I have been threatened with a mechanics lien. Any advice? Thoughts? ps: I have an email in which the plumber said he charges at $160 per hour per man. Accordingly the cost should have been $2400, not $4500....Read More

We sent a lien notice on an Arkansas project. The notice was correctly sent to everyone required to receive it, and the notice itself was correctly prepared...except for this one small mistake. Arkansas preliminary notice laws require that all notices contain the "NOTICE TO PROPERTY OWNER" text provided in the law. This text was included in our notice. However, the notice contained a single, small mistake. The notice in the law requires the paragraph to say: "IF BILLS FOR LABOR, SERVICES, OR MATERIALS USED TO CONSTRUCT OR PROVIDE SERVICES FOR AN IMPROVEMENT TO REAL ESTATE ARE NOT PAID IN FULL..." Our notice provided the entire paragraph correctly, except, in this first sentence, the words "OR PROVIDE SERVICES FOR" were inadvertently omitted. Does this void the entire notice? Or is this notice still likely effective?...Read More
