We are a small engineering firm that does not perform construction work or installation of materials. We were contracted to provide materials in accordance with someone else's design, perform an instructional visit to the job site to train the contractor to install the materials correctly, and finally to provide acceptance testing and approval of their installation. In our proposal we have language that prohibits the with holding of retainage if we did not install the materials, but our client with held the money anyway. Do we have any recourse and if so, what?

New YorkWith everything going on these days I'd hit Financial hard times and I had asked a friend of mine if I could rent their RV. We Came Upon of an agreement that I could stay in their RV for $400 a month and 4 payment of that $400 a month I was too repair the RV it maintenance and upkeep to the RV and yard. Anyting over that $400 a month he would reimburse me for whether it be supplies materials or anything else needed to establish the upkeep and maintenance of the RV and yard. And now they are refusing to pay me for my labor and supply cost that I have had to put into the maintenance and upkeep to the RV and yard. And since I moved in to the RV March of 2021 I have put in approximately 8 to 10000 dollars into labor cost and materials and he is refusing 2 pay me the difference and is trying to say I owe him money for staying here in his RV is this something that I can file a contractor or mechanics lien on?

I feel like he should do some WORK before a draw of any kind If hes short on cash then close of day, but even that is short for the owner...what if he doesnt stick with the job and complete? Owner liability again and delays completion of project.

North CarolinaWe have stored materials and I'm trying to figure out if I withhold retention on the stored materials.
TexasWe are 99.9% completed on a project everything with the exception of the landscaping. The retention was reduced to 5% a few months ago but they are refusing to reduce to at least 2 1/2% until fully completed. The amount of work is equal to about 10,000 and they are holding 180,000 in retention. Some of the subcontractors have been completed for over 10 months. What does the law state about this?
IllinoisI didn't get a copy of the report indicating that my Lien has been finalized for my records, now that payment has been rendered? I need a copy to prove it’s been finalized through the county. I don't know if this is correct or not, but I just learned that it could effect me, if I don’t provide proof that the account has been closed.
FloridaI am working for a construction company and I am doing research on the states in the United States that accept retainage bonds. I know that not every state accepts Retainage bonds (for example, I know Tennessee doesn't while Washington does). Could you please provide a list of the states that do accept Retainage bonds?

Our supplier York international who provided roof top units has filed a lien for non payment
We are being told by the owner and GC that they must submit a release in order to get final payment. However, I have not been paid in full as they are submitting back charges that we were never made aware of until yesterday and the project t is complete. They owe Over $60,000 in retainage and CO but want to reduce our contract about $17,000. Do we legally have to pay YORK to release the lien even if we are not fully paid?
I have signed a partial lien waiver for portions of this contract.
VirginiaA public construction project with a County in California. 5% retention is withheld by the County on progress payments until the project is complete.
CaliforniaWe've completed a project for multi-family housing and the prime contractor keeps telling us the bank is "not accepting applications for retention yet". No Notice of Completion has been filed, so what determines "substantial" completion? We were 99% done with our contract in the final week of April and had to wait on others but we're now 100% complete with our scope as of June 15th. To the best of our knowledge, all other subs are 95+% complete as well, and I just saw that the landscaper filed a mechanic's lien. Do we send in our retention bill anyway, and what can we do if it's rejected? Thanks!

CaliforniaI am curious about something, We have a contract with the city of Richland WA to build them a new substation, on this particular project we are have subcontracted out the design and fabrication of steel to one company, are we required to hold 5% retainage on them? Another question, are they required to pay prevailing wage to their subcontractor (fabricator- steel)? they don't pay prevailing wage to their designers and engineers?
