We are a small engineering firm that does not perform construction work or installation of materials. With everything going on these days I'd hit Financial hard times and I had asked a friend of mine if I could rent their RV. We Came Upon of an agreement that I could stay in their RV for $400 a month and 4 payment of that $400 a month I was too repair the RV it maintenance and upkeep to the RV and yard. We are 99.9% completed on a project everything with the exception of the landscaping. The retention was reduced to 5% a few months ago but they are refusing to reduce to at least 2 1/2% until fully completed. The amount of work is equal to about 10,000 and they are holding 180,000 in retention. Some of the subcontractors have been completed for over 10 months. We are being told by the owner and GC that they must submit a release in order to get final payment. However, I have not been paid in full as they are submitting back charges that we were never made aware of until yesterday and the project t is complete. They owe Over $60,000 in retainage and CO but want to reduce our contract about $17,000. Do we legally have to pay YORK to release the lien even if we are not fully paid?

We've completed a project for multi-family housing and the prime contractor keeps telling us the bank is "not accepting applications for retention yet". No Notice of Completion has been filed, so what determines "substantial" completion? We were 99% done with our contract in the final week of April and had to wait on others but we're now 100% complete with our scope as of June 15th. To the best of our knowledge, all other subs are 95+% complete as well, and I just saw that the landscaper filed a mechanic's lien.
