I'm a commercial painting sub contractor working at a U of M building in Michigan. I'm completely done with the project since December 31, 2021 and have been paid for all except our 10% retention. The General Contractor is saying that the owner will not pay out retention until two change orders are dealt with for another sub contractor (not us). This project started back in early 2021 and I don't see that the Office Manager at that time sent a Notice of Furnishings. Do we have any lein rights to collect our balance?...Read More

Hello - your summary of Kentucky retainage law seems to indicate that there is no escrow requirement. KRS 371.160 seems (for larger projects) to indicate otherwise. Is KRS 371.160 inapplicable? If so, why? Thank you....Read More

I am a subcontractor. I have signed all the proper forms of release to get payment. I haven't received my money. The other contractors have. now I'm being told the prelim was done wrong after I have signed everything and that is nothing they can do for me on some of these jobs. There is another GC I need to file a lien on before I can't that money either. What do I need to do to take the proper steps to get my money? please help...Read More

Hello, Im a subcontractor working on a large job in south florida. We finished the work for the GC over 7 months ago & and it was accepted.... we got paid all the progressive payments (very difficult although to get paid by them) but we still have not been paid the retainage. Level set is saying i cant lien the property because its been over 90 days..... of last furnishing work, I think they have finished the job and turned it in to the owner this month and i cant get a hold of them for my money, what can i do?? If there is contract for over $500,000 that exists between the owner and the GC, can the owner opt not to hold retention so owner would not have to open an escrow account for retention? If so, can the GC hold retention on his subcontractors? If the GC can hold retention on his subcontractors, does that mean the GC is required to open a single escrow account as an "umbrella" for all of the subcontractors together? Or would the GC have to open a separate escrow account for each individual subcontractor? If the owner does not hold retention on the contract over $500,000, should the GC then not hold retention since, technically, the GC would be paid all monies owed to the GC since the owner did not hold retention on the GC? These laws regarding retention and escrow accounts are really confusing to me. Thank you in advance for your help....Read More

For Retainage are you limited to the 90 day for Filing a Lien in Florida? We have a job that was Bonded and a Hud job that we've been told repeatedly that the owners and Hud had not signed off on for retainage to be released. We had personally changes in the office and were not sure when the project was actually approved for retainage billing. After several months of being given the run around from the GC about the status of the retainage we submitted a lien. Now we have been contacted from an Attorney of the Owners stating that we can't file this lien due to the time frame of when we were last on the project. However the project was not closed out until after 8 months of when we were on site and it was released to bill retainage. ...Read More
