We file a notice of contractual retainage on time, but I'm wondering when we should file a lien or bond claim. I'm a subcontractor that performed framing on a commercial project in Texas, everything was paid except the 10% retain for issues between the owner and the general contractor. Our trade was completed and the only reason i haven't been paid is because of a disagreement between the owner and GC unrelated to my work. The retain invoice was due 12/23/2019 and i still haven't been paid. can i still file a lien on the property? owner and GC says that as soon as they come to an agreement i will get paid but it has been 5 months already and they cant seem to reach an agreement. My contract says that i am entitled to legal fees compensation if i win the case. Thanks....Read More

We are a manufacturer's rep for commercial HVAC equipment - meaning we purchase from the manufacturer and then ship it to a job site. We bill the mechanical contractor who ordered it from us and they do the installation (set the unit, piping, etc.) and then part of our obligation is to provide a factory authorized company to officially start up the unit, who we hire and pay as a subcontractor. Question is - when we bill the mechanical contractor for the unit, they are holding 10% retainage on our invoices. Note that we do not bill the entire amount of our sale to them (for example, if the unit is $25,000, we bill only $24,000 and leave $1,000 balance to bill when the unit has been satisfactorily started up. Do they have the right to hold this 10% of the $24,000? If not, can I get a copy of the law that addresses this? Thanks!...Read More

I am a subcontractor to a mechanical contractor in Georgia. The mechanical has a large contract with a GC that is doing a project at a public College. We have completed our part of the work over three months ago and submitted for payment and got paid all but 10% of the project. The mechanical contractors contract is on going and they say that we cannot get paid until his contract is completed and he submits for payment for our retainage along with his.
