We have to pay our lumber, window, door etc. suppliers 100%. Is there a way we can add a clause to the contract that retainage will not be held on materials? Otherwise...we have to finance that project until we are paid the retainage (40 days after substantial completion). When filling Mechanical Lien, the "Claim amount", do we need to include retainage amount as well ? Ex. We have outstanding Invoice for $9,000 and $1,000 in retainage. We are a sub tier subcontractor and our GC put a hold on funds for "project a". The reason is because the tier above us (who we are subcontracted to) will not provide an unconditional lien release for "project b". They are 2 different projects with 2 different contracts.
