Hello,
I sent a mechanic lien notice to a customer who won't pay for a finished project. He in turn has hired an attorney and we have received a notice of claim with a lot of false accusations.
TexasAs a subcontractor on a private commercial job, retainage was billed on 5/31/20 (last date of work). What is the lien filing requirement? This is the only amount due at this time.

TexasIf the owner sells his building before the retainage is due, does he have to give me the full amount of retainage at the point of sale?

FloridaWe were told the owner was not going to pay the GC anymore and our retainage has not been paid. We just got into Level Set and missed the deadlines regarding notices. Is there any action we can take to get a lien on the property?
TexasWe have to pay our lumber, window, door etc. suppliers 100%. Is there a way we can add a clause to the contract that retainage will not be held on materials?
Otherwise...we have to finance that project until we are paid the retainage (40 days after substantial completion). Sometimes we have enough "fluff" in project to cover this...but not usually.

As a California subcontractor how long can the general contractor hold our retention? We have been finished with our portion of work for 3 months, but the overall project isn’t complete. Dies the entire project need to be complete in order for us to receive our final payment?

CaliforniaWhen filling Mechanical Lien, the "Claim amount", do we need to include retainage amount as well ?
Ex. We have outstanding Invoice for $9,000 and $1,000 in retainage.
If we were filling a Mechanical Lien, what would the claim amount be ? $9,000 or the full invoice with retainage of $10,000 ?

OhioWe are a sub tier subcontractor and our GC put a hold on funds for "project a". The reason is because the tier above us (who we are subcontracted to) will not provide an unconditional lien release for "project b". They are 2 different projects with 2 different contracts. I would think that this is illegal due to prompt payment laws? We have been paid in full including retention for project b.
CaliforniaI made monthly process payments that are due in 30 days, retainage is the finial payment. Is that due in 30 days like all the other payments?
