We agreed to take on a renovation project for a national property management company in California, the project is in our home state of New York. The project had a scope of work with one price to do it all. The property changed hand due the renovation and we were ask to stop work. There are items that are not quit completed and the are trying to tell us they are only going to pay so much and we do not agree with the suggested amount and they are also stating the there is poor workmanship. We where on the project for a couple months with no inspection. We are not sure how to handle this but we have always done good work. There was a change order that we gave them for work that needed to be done for the home to qualify for loan like FHA etc. Some of the work that needed to be done was work that we did not complete due to the change order. Example: We did not paint 3 ceiling due to buckling drywall and the change order was to replace the ceiling, 5 interior doors needed replaced due to condition which was on change order so we did not paint them. there was a couple more items like these example. so now that they decided not to move forward we are out. Th project was ok with the whole price but now with all the missing item it was a loss to use. If we would have known we would have never taken on the project....Read More

We hand laid 2125 sq ft of asphalt for a company and when we finished the job they complained about the asphalt not meeting up with the top of the concrete. They never stated that was how they wanted it and its not written in the contract that way....Read More

We have a customer we supplied work to back in March/April. He has been in our collections agency for a few months. We do have a Progress Payment Contract and Judgement Contract with him. We are wanting to now file a lien against his site. we did not send certified notices, everything was done through email and with these two contracts. will that work if we place a lien on his Gas Station?...Read More

Since sept 20 our final day the general contractor ask us for estimate on tile later a few days the chef estimator call me and ask if I would do it for thousand less I agree time came to install tile .in the mean time the super on job didn't surface concrete and it was very corse in some places 1/2 others 3/4 he said just install it with more mud. not common practice to us or any one in construction .after installing first few tile the super walk on our work not set yet with his people causing movement and poor quality looks blaming us for his actions .this went on with everything we did he made the calls to close up walls drywall when I knew the other trade were not ready causing to tare drywall back out at our cost when he and his company cause this damage on the tile floor walls ceilings we have proof and the subs and trades are willing to testify...Read More

I had an verbal agreement with the owner of a industrial property. He agreed to have me repair the cracks at $10/linear foot. I am an Architecture firm who contracted with a developer to do permit drawings on a property the developer owns. Terms of the contract state that the balance of payment is due upon the sale of the property. however, the developer has not worked on the project in 6-8 moths and we know to be struggling to keep other jobs afloat. Is a Mechanics Lien the right way to secure that we are paid upon sale of the house? He is not in breach of Contract yet, and the work we performed was over the 90 ago so not sure we can file a lien. We do not want to be in a situation where if the developer does sell (prior to completion or after completion) to pay off debts owed to others and we are not then compensated.
